According to the suit filed by Ogwuche at the Federal High Court in Abuja on Thursday, he prayed the court to compel the Federal Government to pay him the sum of N100million as damages.
The suspect insisted that his continued detention in the custody of the Department of State Security, DSS, amounted to a gross abuse of his fundamental human rights as enshrined in the 1999 Constitution.
Ogwuche contended that the Federal Government, having breached his constitutional rights, ought to be compelled by the court to pay damages to him.
He also prayed the court to order his immediate release from detention pending whenever the government is ready to conduct his trial.

Ogwuche, a suspected Boko Haram member, was accused by the Nigerian government of being behind the attack.
The suspect reportedly fled to Sudan after coordinating the attack. He was later repatriated to Nigeria by Interpol to face charges.
Aminu Ogwuche was said to have been radicalized while studying at a South Wales university.
It will be recalled that the State Security Services (SSS) on May 15, 2014, Thursday,announced the arrest of Col. (rtd) Agene Ogwuche, the father of Aminu Owuche.
